Cashless Poland is a colloquial name of the Support Programme for Cashless Poland. It is a joint project of the payment services sector – the Polish Bank Association, the Ministry of Entrepreneurship and Technology, clearing agents and Mastercard and Visa payment organizations.

Can I use the terminal to accept payments in foreign currencies?

Yes, absolutely. In this situation, the payment terminal automatically converts the transaction amount into the selected foreign currency at the current exchange rate. The customer sees the final amount due, along with the exchange rate used, even before authorization. Once the transaction is approved, the funds are converted back into the local currency and transferred to your bank account.

What security measures are used at payment terminals?

Payment terminals are equipped with various security measures to prevent fraud and ensure the protection of customer and merchant data. First and foremost, all payment card and transaction data is encrypted during transmission between the terminal, the PSP system, and the bank, making it difficult for third parties to intercept and misuse the data. Before a transaction is processed, the terminal must obtain authorization from the customer’s bank, which effectively prevents potential losses for the merchant.

Is it mandatory to have a payment terminal?

Pursuant to Article 19a, paragraphs 1 and 2, of the Entrepreneurs Act (Journal of Laws of 2021, item 162): “An entrepreneur shall ensure the possibility of making payments at any location where business activity is actually carried out, in particular on the business premises, off the business premises, or in a vehicle used to provide passenger transportation services, using a payment instrument as defined in the Act of August 19, 2011, on Payment Services.” These provisions are effective as of January 1, 2022.

In theory, the aforementioned payment instrument could also be a BLIK code or a bank transfer; however, practice shows that the most convenient and reliable way to comply with the law is to use a POS payment terminal.

As an exception, businesses that are not required to use cash registers to keep sales records (because they benefit from a subjective or objective exemption) are exempt from the requirement to offer cashless payments.

What are the consequences of not having a terminal?

A business owner who does not accept cashless payments risks losing the right to expedited VAT refunds and quarterly filings. If a lack of integration between the cash register and the payment terminal is detected, the tax office may impose a fine of 5,000 PLN.

Do I need to register the terminal with the tax office?

No, there is no requirement to register a payment terminal with the tax office. It is a device that works in conjunction with a cash register, but it does not require separate registration.

Can any business owner have a payment terminal?

Yes, virtually any business owner can have a payment terminal, regardless of the size of the business or the industry in which it operates. The only requirement is to have a cash register. Currently, however, payment terminals are not available to private individuals.
